A human rights advocate group under the aegis Registered Trustees, Center For Transparency & Defence of Human Rights has dragged the Nigerian Army to the Federal High Court in suit no FHC/WR/CS/57/2020 over the unlawful killing of late Joseph Pessu, in order to enforce the deceased fundamental right.

In a Motion on Notice filed by the Group through its lawyer, Kunle Edun, which was made available to TheNigeriaLawyer, it urged the Court to declare the killing of the deceased as unlawful and a gross violation of the right to life, human dignity, fair hearing and freedom of movement.

Furthermore, the suit seeks a declaration that the death of the deceased had caused irreparable loss to members of the deceased family, “siblings and aged parents (who mostly rely on him for substance) being the breadwinner of the family.”

In addition, the suit alleged that Sergeant Ilekura Ajayi Samson of Nigerian Army caused the death of the deceased and as such urged the Court to compel Attorneys General of Federation and Delta State to commence his prosecution.

“An order compelling the 3rd & 4th Respondents to immediately commence criminal prosecution against the 4th Respondent for the unlawful killing (murder) of late Joseph Pessu on the 2nd day of April, 2020.”

Furthermore, the Group seeks punitive, aggravated and exemplary damages of 3 billion naira for the unlawful killing of the deceased.

Meanwhile, the other parties in the suit are Nigerian Army, Chief of Army Staff, Attorney General of Federation, Attorney General of Delta State and Sgt. Ilekura Ajayi Samson.
