OFFENCE OF REFUSING TO AID A POLICE OFFICER WHO IS ASSAULTED.

In Nigeria, it is an offence to refuse to assist a Police Officer who is assaulted in the course of his duty.

PENALTY
6 months imprisonment or a fine of ₦50.

SEE SECTION 40 OF THE POLICE ACT.

The offence is committed if a person refuses, without lawful excuse, to assist a Police Officer being assaulted or obstructed when making an arrest, and who calls upon that person to assist him, but fails to lend help.

In Nigeria, Police Officers are assaulted on a regular basis, but, spectators are rarely prosecuted.
