The Nigerian Bar Association (NBA) has condemned the Nigeria Police Force for their decision to withhold security during the local government elections in Rivers State, labeling it unconstitutional amid ongoing electoral controversies.

In a statement released by NBA President Afam Osigwe on his official X (formerly Twitter) account, the association emphasized that the police’s stance violates their constitutional duty to protect lives and property.

Titled “The Nigeria Police Force Cannot Shirk Their Responsibility to Provide Security in Rivers State,” the statement expresses serious concern over the police’s failure to secure the elections scheduled for Saturday, October 5, 2024.

Osigwe referenced comments from Rivers State Police Public Relations Officer SP Grace Iringe-Koko, who indicated the police would not provide security. The NBA also raised alarms about allegations of police attempts to remove electoral materials from the Rivers State Independent Electoral Commission (RSIEC) office at night.

While acknowledging potential court directives affecting the police’s relationship with the electoral commission, the NBA insisted that this does not absolve them of their fundamental duty to maintain order during elections.

“The responsibility of the police to ensure peace and security in Rivers State is constitutional and cannot be restrained by any court. They must fulfill their duties at all times and take necessary steps to challenge any judgment that hinders their constitutional responsibilities,” the statement asserted.

The NBA warned that the refusal to provide security could lead to lawlessness, undermining democracy and leaving Rivers State residents vulnerable. They labeled the police’s decision as illegal, immoral, and a dangerous precedent for the democratic process.

Governor Siminalayi Fubara, currently in conflict with the Inspector-General of Police over alleged bias, remains determined to proceed with the elections despite security challenges.

The NBA pledged to closely monitor the situation, asserting that any failure by the police to ensure security would constitute a serious violation of the rights of Rivers State citizens. This incident further escalates tensions in Rivers State, where local government elections have been fraught with legal disputes, protests, and political strife among key stakeholders.
