Three of the four chairmanship aspirants to the office of Chairman, NBA Ikeja branch, have dragged the leadership of its association and the defunct caretaker committee of NBA Ikeja branch to court, challenging the legality of the defunct caretaker committee to issue notice for election in the branch slated for 29th September, 2020.
In the suit they filed at the Lagos state High court, through an originating summons, they prayed the court to among others stop the purported election of the branch which was slated for the 29th of September, 2020.
In the affidavit in support of their process, they raised a fundamental issue of incompetence of the remaining members of the committee not having the power to continue to exist as a caretaker committee and as such do not possess the necessary capacity to conduct any election for the branch. They stated their view on the basis that the current members of the caretaker committee, having fallen short of the statutory numbers as provided under article 11(1)(a) of the NBA uniform bye-law for branches 2015 and the instrument of their appointment which specifically appointed three past chairmen of the branch namely; Bisi Ade-Ademuwagun, Adegbamigbe Omole and Mr. Monday Ubani on the 23rd of June, 2020 have lost any legal or moral authority to exist as a committee consequently do not have the capacity to conduct any election for the branch.
They were reinforced in this position because of the resignation of one of the committee members who was jointly appointed by the instrument from the national body of the NBA dated the 23rd of June, 2020. The resignation of one of the members namely, Mr. Monday Ubani, former 2nd Vice President of NBA occurred on the 18th of September, 2020 which chronicled several infractions by the other members of the committee, especially their flagrant disregard of the constitution of the NBA, disregard to directive from the appointing authority as well as disobedience to NEC resolution taken in Jos in 2016 concerning the application of article 6 (3) to candidates who failed the test of that article. The other committee members, Mr. Bisi Ade-Ademuwagun and Mr. Adegbamigbe Omole are yet to deny this allegation.
Their alleged brazen impunity to conduct the branch election excluding the office of the chairman has necessitated the present action in court.
It will recalled that the same candidates have earlier on written a petition to the president of the NBA demanding the disbandment of the Committee as they have fallen short of the requisite number as provided by the Bye-Law of 2015 due to the resignation of one of their members in the person of Monday Onyekachi Ubani Esq, former Chairman of the Branch.
No date has been assigned for the hearing of the suit.
