The Gombe Branch of the Nigerian Bar Association has criticized Governor Muhammadu Yahaya’s Executive Order 007 on BAP 4, which revokes land use rights in the state. The association is urging the governor to reverse this order, citing its violation of the Land Use Act.
In a communiqué jointly signed by Chairman Barrister Benjamin Sati and Legal Adviser Barrister Abubakar Bafeto, the Gombe Bar emphasized the need for immediate action. They called for:
Reversal of the Revocation: The association insists that the governor should annul the order as it contravenes both the Land Use Act and the Constitution of the Federal Republic of Nigeria (1999, as amended), as well as established judicial authorities.
Suspension of Documentation: They requested a halt to the documentation processes related to this revocation to prevent potential litigation.
Enforcement of Legal Protections: The Gombe Bar stressed that all land revocations should comply with established legal frameworks to protect landholders’ rights.
The communiqué further stated, “We are united in defending the rights of landholders and promoting justice in land governance. Addressing these issues is vital for fostering a fair and equitable society.”
Additionally, the association urged Governor Yahaya to prioritize the welfare of judicial officers in the state. They highlighted the need for better housing, medical services, operational vehicles, and essential equipment to ease the burden on judicial personnel.
While commending the government for completing the Shariah Court of Appeal Complex and constructing a state-of-the-art High Court Complex, the Bar noted, “Judicial officers should have secure and designated quarters. A reserved area for High Court judges and magistrates within the metropolis is imperative.”
The Gombe Bar also pointed out that many judges have been using the same vehicles for over 13 years, leading to significant wear and tear. They emphasized the importance of replacing these vehicles to enhance efficient justice delivery.
