Education is one of the most important investments a country can make in its people and its Future. Plethora of International Human Rights Laws Instrument considers education as a basic right and not a privilege, which serves as an adjuvant to human, social and economic development.

The wider definition of education has been recognised in Article 1(a) of United Nations Educational Scientific and Cultural Organization (UNESCO)1974 Recommendation Concerning Education for International Understanding, Co-operation and Peace and Education Relating to Human Rights and Fundamental Freedom.

‘’the entire process of social life by means of which individuals and socialgroups learn to develop consciously within and for the benefit of the national and international communities, the whole of their personal capabilities, attitudes, aptitudes and knowledge.’’

The 1960 UNESCO Convention against Discrimination in Education also defines education in Article 1 (2) as

‘’all types and levels of education, (including such) access to education, the standard and quality of education, and the conditions under which it is given.’’

Human Rights are inherent to all human beings, regardless of race, sex, nationality, ethnicity, language, religion or any other status. Human Rights are foundations for freedom, justice and peace in the world. They are formally and universally recognised.All human rights including right to education is universal, indivisible, interrelated and independent.Right to Education as one of the fundamental human rights is recognised Internationally by the Universal Declaration on Human Rights (UDHR), which proclaims in Article 26 that ‘’Everyone has the right to education.’’ Hence this applies to all, both the privileged and underprivileged, rich and the poor, irrespective of their Status. Furthermore, the Constitution of the Federal Republic of Nigeria 1999 gives in Section 18(3) The Fundamental Objectives and Directives Principles of State Policy pertaining to Education, Section 18(2) Similarly sets out the need and also how to make education available, accessible, affordable and adaptable to the Nigerian citizens by the government from primary to tertiary level.

Education as a human right is also regulated by Federal and State Statutes along with Other Subsidiary Legislations on Education, which are relevant. They are enabling laws for establishing, monitoring, and regulating educational agencies, which are charged with the responsibilities of upholding and ensuring the accomplishment and Sustenance of the National Objective of Education as contained in the National Policy on Education (NPE). Some of these laws are; The Universal Basic Right Act, Child Right Act, National Examination Council Act, West African Examination Council Act, Nigerian Education Bank Act, African Charter on Human Right and People’s Right.

The Awareness of Right to Education to underprivileged is not predominantly known. There is the need for the society at large to help underprivileged know their Right to Education as their fundamental human right. Educational right is an integral part of those expectedly guaranteed rights which requires serious attention in the area of enforcement. Education to underprivileged can be actualized with the help the of government, here the governmental body can create Awareness of Right to Education by providing free and good quality education to underprivileged, by making sure all children and adults can access education without discrimination. Individuals can also help realise this by enlightening underprivileged on their Right to Education, as a Journalist you can unpack essential issues that are impeding access to education, as a student you can also help peers stay motivated and focus in school, you can create time to enlighten the underprivileged persons in your Community, as a Lawyer you can inform citizens about their judicial Right to Education and so on. Another very important agent that can enhance the awareness of education to underprivileged is the Civil Society Organisation such Non-Governmental Organisation (NGO’s) which can aid by financing education and improving educational outcome. This will help tremendously in the Awareness of Right to Education to the underprivileged in our society at large.

Finally, when there is Awareness of Right to Education tounderprivileged, it enables them to have access to other fundamental human rights, that is it makes it easy for them to comprehend and have an insight of other fundamental human rights which they are entitled to and avoid their rights from being trembled upon. Education enhances an Individual’s chances in life and helps to tackle poverty, decrease social inequalities, reduce gender based violence and empowers individuals reach their full potential which helps the society to achieve lasting peace and sustainable development.
