Daily Law Tips (Tip 472) by Onyekachi Umah, Esq., LLM. ACIArb(UK)

ASSISTING ANY PERSON TO ENTER OR ATTEMPT TO ENTER INTO ANOTHER COUNTRY ILLEGALLY IS A CRIME IN NIGERIA.

Helping, assisting or playing any role knowingly for illegal entry of any person into any country of which the person entering or attempting to enter is not a resident or citizen, is a crime.

It is a crime where such conduct of procuring illegal entry is done knowingly and for a financial/material benefit, directly or indirectly. This also includes facilitating or promoting actual or attempted illegal entry into, transit across or stay in a country where the person entering or attempting to enter is not a citizen or resident. Illegal entry is crossing borders without the necessary requirements for legal entry into the receiving country.

This offence is punishable with imprisonment for not less than 5 years without an option of fine.

My authority is sections 26(1),(2),(3), 82 and 83 of the Trafficking in Persons (Prohibition) Enforcement and Administration Act, 2015.
