An Abuja based legal practitioner, Vincent Adodo, Esq., has dragged the military authorities to court for causing traffic gridlock on Mararaba-Nyanya-Aya Road on Monday, the 7th February 2022 when soldiers embarked on an endurance trek from Mogadishu Barracks to Kubwa Highway, Abuja.
In the suit- FHC/ABJ/CS/208/2022: Vincent Adodo, Esq. v. Chief of Defence Staff & 3 Ors, and made available to BarristerNG, the Applicant is, among others, seeking an order of the Court declaring the holding of the said endurance trek on the morning of a working day being Monday the 7th Feb 2022 as illegal and unconstitutional being a breach of his fundamental right to movement.
The Applicant is also seeking 20M damages from the respondents.
Part of the relief reads “A declaration that the ‘endurance trek’ embarked upon by soldiers in the Federal Capital Territory on the morning of a working day being Monday the 7th day of February 2022 between Mogadishu Barracks (otherwise known as Abacha Barracks) and Kubwa Highway, Abuja FCT at the instance and/or upon the directive of the Respondents which ‘endurance trek’ impeded the free flow of human and vehicular traffic on the Mararaba-Nyanya-Aya Road which in turn impeded the free movement of the Applicant on the said morning is arbitrary, oppressive, insensitive, illegal and a restriction on the right of the Applicant to freedom of movement.”
The matter is fixed for the 24th November 2022 for hearing of Applicant’s motion for amendment
