An Abuja based Lawyer, JohnMary C. Jideobi has discontinued the case filed against the Chairman of the Economic and Financial Crimes Commission, EFCC, Abdul Rasheed Bawa and two others.

Mr. Jideobi had asked the court to declare Bawa’s seat vacant as the constitution did not make provision for the office of the EFCC being occupied by a convict.

Recall that Newsmen reported that a federal high court sitting in Abuja last week set aside it’s order convicting the EFCC boss.

NOTICE OF DISCONTINUANCE

TAKE NOTICE that the Plaintiff wishes to and doth hereby discontinues this suit against all the Defendants.

FURTHER TAKE NOTICE THAT THE GROUNDS upon which this Notice of Discontinuance is pillared are set forth below:

1. The Originating Summons was predicated on the Ruling of the Federal Capital Territory, Abuja, High Court rendered by the Hon. Justice C. Orji on the 28th day of October, 2022 convicting and sentencing the 1st Defendant to prison.

2. On or around the 10th day of November, 2022, after the institution of this suit, the Plaintiff became aware, later that day, that the High Court of the Federal Capital Territory, Abuja, who earlier convicted and sentenced the 1st Defendant, has vacated its Ruling effectively setting aside the conviction of the 1st Defendant.

3. Arising from paragraphs (1) and (2) above, the substratum of the instant application is no more in existence and pursuing this suit any further would not serve the ends of justice.

4. Pursuing this suit beyond this point would only serve the purpose of dissipating the scarce energy and time of the Honourable Court and unnecessarily wearing out the Defendants.

5. It is in the public interest that a suit, such as the instant application, which no longer has any basis or which has been overtaken by event, is terminated.
