Court restrains Navy from stopping construction of filling station

An Ondo High Court has restrained the Navy from stopping the construction of a petrol station in Igbokoda, headquarters of Ilaje Local Government Area of Ondo State.

The petrol station is being constructed opposite the Forward Operating Base of the Navy in Igbokoda.

Counsel to the firm, Barrister A. O. Meduaye, had filed a suit at the High Court to stop the Navy from disturbing and harassing the workers working on the construction site of its filling station

Other defendants in the suit are Attorney General of Federation and the Commanding Officer, Forward Operating Base, Igbokoda, Navy Capt. Lanre Akeem Aubade.

Meduaye said his client bought the land opposite the Naval base for the construction of a petrol station and had obtained all necessary documents for the acquisition of the land but was obstructed by Naval personnel.

He urged the court to stop the defendants from obstructing the construction work on the land..

In his ruling, Justice Alero Akeredolu, ordered the defendants not to disturb, harass or intimidate the workers on the construction site.

According to him: “I have carefully reviewed the facts in the affidavit of urgency and the affidavit in support of the motion. They reveal prima facie substantial interference with the applicants property, and it is my considered view that if not restrained the respondents may continue to harass or intimidate the applicant.

” I am also satisfied that the urgency is not self induced. This is an appropriate instance to exercise the discretion of this court to prevent arbitrariness.

” This court therefore makes an order of interim Injunction restraining the respondents by themselves, their agents, staffs, servants, employees, officers, privies of whosoever accruing through or for them from further invading, disturbing, harassing, intimidating and/or preventing the applicants’ employees and/or workmen from going into the construction site of the petrol filing station at Broad Street, Igbokoda, pending the final determination of the application of enforcement of their fundamental rights in this suit.”
